By commissioning me, you acknowledge and accept all terms listed below

Basic/Condensed TOS

+Unless discussed, you may not use my art for commercial or for-profit purposes, or to advertise without my consent/endorsement
+If reposted I must be directly credited
+I require proof of age for NSFW commissions. If NSFW comms are bought by or for a minor, or contains the characters of a minor, all parties involved will be blocked and blacklisted
+If purchasing a custom character, you may not upcharge a resale without adding extra value yourself
Base prices are ALWAYS subject to change based on complexity of the requested commission
+A toyhou.se account is REQUIRED for you to own any of my designs so I can protect myself and you from scams
+Edits made to the commission will incur extra fees after a certain point
+MY WORK IS NOT TO BE USED IN ANY WAY WITH AI OR MACHINE LEARNING=======================Section 1. Image Copyright

1. I, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own or use it for anything other than personal use.
2. All commissioned artwork is for non-commercial purposes only. Redistribution of my work for use in printed merchandise or as promotion of goods, services or social media pages is prohibited unless those rights are purchased from me. If you have any questions about this, ask me before commissioning me.
3. Conditions for Reposting: The client has my permission to repost the artwork wherever they would like, as long as proper credit is given (ex. such as leaving a link to one of my sites) and my watermark/signature remains intact and unaltered.
4. Ownership of original design work: By purchasing a premade, custom, or any other form of character design from me, you acknowledge that I require clients to a.Be in possession of a toyhou.se account, b.Be willing to accept the original design work in the form of a character profile on toyhou.se, and c.Keep myself listed as the creator/designer of the character no matter how many redesigns or other transactions the design undergoes.
5. Prohibited Actions: a.Altering my artwork in any way without asking for permission before hand, with the exception of the client cropping/resizing the image for an icon or other use. b.Directly copying my artwork as references for your own, such as directly tracing all or parts of the image. c.Claiming the artwork as your own. d.Should the client decide to change or adjust the commissioned works through the use of machine learning or derived technologies, I will consider this an automatic purchase of exclusive rights and charge the standard fee per artwork. Please inquire about the exact fee for your commission in advance. e.Any form of using my art for training machine learning, or AIs, is expressly prohibited. Any kind of alteration of my artwork using AIs or other machines is expressly prohibited. This will result in an automatic blacklist from any and all services from myself and extra fees if the offender is a client.=======================Section 2. Payment Information:

1. I accept payment via Square, Zelle, and Paypal. Square is my preferred method of payment. Due to fees and lack of adequate seller security, PayPal payments are subject to a 10% base fee increase. This upcharge DOES NOT include taxes.
2. The artist will NOT begin any work until at least 50% payment has been paid by the client. Any edits on the initial rough is $2 per change after 2 free edits. Edits past the lineart stage will be $5 after one free edit. Edits requested after completion of the artwork will be $10.
3. Unless payment is completed upfront, the client will be given 48 hours to pay the remaining fee after confirmation of the rough sketch. Non-payment after 48 hours will result in the commission being canceled. Progress up to this point may be repurposed at the artist’s discretion. I have no intention of using anyone’s original character without their permission, the work will be altered to prevent unintentional repurposing of likeness.
4. Custom design work cannot be resold higher than bought for. The client must add value to the character in order to charge more than the original base price commissioned for. This includes, but is not limited to, writing works, personal and/or commissioned art, and/or physical artwork and items.
5. Refund Policy: No refunds once art is completed. If canceled before art has been completed, the client will receive a 50% refund. The artist reserves the right to cancel a commission at any time, for any reason, and without explanation.=======================Section 3. Contact and Communication

2. Visual Reference Guidelines: Client must provide at least one clear and concise visual reference of the character(s) to be drawn. Extra fees will incur if a visual reference is not available. Sketches, doodles, and even stick figures are a welcome addition if it will help communicate what you’d like.=======================Section 4. Will/Won’t Draw

Below is a general guideline for what I will or will not draw. Please keep my art style in mind when ordering, I’m not going to emulate someone else’s style.
1. Allowed Content:
+Humans (Fantasy races included ie. beastmen, lizardmen, etc.)
+Cyborgs
+Androids
+Robots
+Dragons
+Mecha (powered armor, mechs, ships, etc.)
+Gore
+Monsters
+Dinosaurs
+Fanart
+NSFW (Some form of age verification is required. Ex: An ID with sensitive info such as last name and address redacted, with the clients username written beside it or with their face matching the ID photo)
2. Disallowed Content:
+Any form of hateful content, including but not limited to as racism, transphobia, homophobia, colorism (I will not lighten a character’s skin), antisemitism, and/or characters with Nazi/Soviet etc. Imagery or paraphernalia

+Any form of NSFW art representing real people in any non-consensual sense, any kind of representation of real animals or pets (such as an anthro version of a pet)
Any form of suggestive or NSFW art drawn for a minor client or containing a minor’s character(s). IF A MINOR IS CAUGHT LYING ABOUT THEIR AGE TO OBTAIN NSFW ART, OR AN ADULT IS CAUGHT COMMISSIONING NSFW ART FOR A MINOR, ALL PARTIES INVOLVED WILL BE BLOCKED PERMANENTLY.

3. Subjects my skill level may struggle with:
+Manmade scenes, such as cityscapes or neighborhoods
+Vehicles of any kind
+Room interiors, especially those containing lots of small trinkets
+Detail heavy backgrounds=======================Section 5. Workflow Process

1. I work well both with artistic freedom and with very specific prompts. Please note, whilst I am able to recreate poses and details, there will be variation, I am not a machine. I will not emulate another artist’s artstyle on request. Whilst I appreciate hyper-specifics, please note that micromanaging will not be tolerated (refer to section 2, point 2 on edit fees).
2. Estimated date to completion. If there are delays in completion, the client will be notified. Commissions are estimated to take between 1 day and 2 weeks depending on complexity and how busy I am.
3. Works in Progress (WIP): After the initial rough sketch is given the go-ahead, updates in progress will be sent to the client at the artist’s discretion.
4. Revisions and edits: after rough sketch approval no major edits or additions will be made. If such requests are made after completion prices may be discussed.
5. If the client does not want me to post the commission on social media, please notify me before your order is completed.
6. Usage of commission for commercial use MUST be discussed before beginning of project and will be priced differently.=======================Thank you for your interest in my artwork. Please feel free to ask questions!
